The effective date of an initiative, if not otherwise specified in the initiative, shall be forty-five days after certification of its enactment by the Electoral Trust.

Many initiatives are very complicated, so should the effective date be more than the 45 days set forth in the Act? In no event, however, should the sponsor of the initiative be permitted to make the effective day the day after the election or before the 45 day period (or whatever period is eventually selected.)

Stern & Holman seem to suggest that an early effective date could be a surprise to an unvigilant electorate. However, this seems unlikely considering that any proposed initiative will undergo a Public Hearing (Act, Section 3-H) to analyze its every aspect. If the effective date is judged faulty then the deliberative committee may modify it.
